The Legislative Decree n. 231 of December 15th, 2017, laying down the disciplinary rules for the violation of the provisions of Regulation (EU) no. 1169/2011, on the provision of information on food to consumers and the adaptation of national legislation to the provisions of the same regulation (EU) no. 1169/2011 and Directive 2011/91 / EU, pursuant to Article 5 of the Law of August 12, 2016, n. 170 «2015 European Delegation Law».
In our previous article (Almater.it/en/labelling-italy-approves-the-sanctions-decree-on-the-regulation-eu-no-11692011) we had already analyzed the contents of the Decree with a summary of the main sanctions that, in the most serious cases such as the omission of allergens or sale beyond the expiration date, may reach up to € 40,000.
The Decree will enter into force on May 9th, 2018, and also regulates the production lot, the sale at vending machines, the sale of non-prepacked food and products not intended for the consumer (B2B sales).
In Article 28, the Decree provides for the possibility of marketing foods placed on the market or labeled before the date of entry into force even if they differ from the same until the stock is depleted.
