This Decree lays down rules for penalties for breaching the rules of:
Regulations (EC) n. 1935/2004 on materials and articles intended to come into contact with food and repealing Directives 80/590/EEC and 89/109/EEC;
Commission Regulation (EC) n. 2023/2006 on good manufacturing practice for materials and articles intended to come into contact with food;
Commission Regulation (EC) n. 282/2008 on recycled plastic materials and articles intended to come into contact with foods and amending Regulation (EC) No 2023/2006;
Commission Regulation (EC) n. 450/2009 on active and intelligent materials and articles intended to come into contact with food;
Commission Regulation (EU) n. 10/2011 on plastic materials and articles intended to come into contact with food;
Commission Regulation (EC) n. 1895/2005 on the restriction of use of certain epoxy derivatives in materials and articles intended to come into contact with food.
This Decree provides sanctions up to 80.000 euros, for small penalties it is possible for the competent Authorities to distrust the offender to regulate his position before the penalty.
The Decree will enter into force by 2 April 2017.
